1. Acceptance of Terms of Use

These Terms of Use (the ‘Conditions’) govern the use of this LiveMusicFinder website ( the ‘Website’).  LiveMusicFinder may modify these Terms and Conditions from time to time and you are advised to keep up to date with any changes by regularly reviewing these Conditions.  By using the Website; either as a visitor browsing the Website without being a registered member, or as a registered member, you agree to be bound by these Conditions.

Nothing on the Website (including, but not limited to, any information placed or statement made by  LiveMusicFinder on the Website) will vary the terms and conditions.

The Website may contain links to other LiveMusicFinder sites or to third party sites which may be covered by separate terms and conditions.

2. Access and Security

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if for any reason our site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our site, or our entire site, to users who have registered with us. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party.

You are responsible for making all of the necessary arrangements to gain access to the website. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them. Live Music Finder will not be liable for any loss or damage arising from your failure to protect the confidentiality of your password.

Live Music Finder reserves the right to suspend User ID and password access to the Website if at any time Live Music Finder considers that there is or is likely to be a breach of security.

For security reasons, passwords must be changed if prompted.

3. Charges

LiveMusicFinder operates a charge and reward system using ‘Credits’. Bands, Venues and Agents will be rewarded in Credits for entering gigs onto the Website. These Credits can be exchanged for LiveMusicFinder services. Additional Credits can be purchased in predefined amounts. Free and reward Credits cannot be refunded.

LiveMusicFinder reserves the right to charge for any of the LiveMusicFinder Services and to change its charges at its discretion. If LiveMusicFinder terminates your Membership because you have breached this Agreement, you shall not be entitled to the refund of any unused portion of paid for Credits or services.

4. Copyright

The content of the Website is protected by copyright, trademark and other intellectual property rights as applicable and is provided solely for your own use.  Republication or redistribution of any of the content available on the Website, including by framing or similar means, is prohibited.

5. Changes to Services

LiveMusicFinder reserves the right at any time to modify, edit, delete, suspend or discontinue, temporarily or permanently, the Website (or any part of it) and/or the information, materials, products and/or services (or any part of them) available through the Website with or without notice.

6. Member Disputes

You are responsible for your interactions with other LiveMusicFinder Users. LiveMusicFinder reserves the right, but has no obligation, to become involved in any way with these disputes.

7. LiveMusicFinder's Liability

To the full extent that this is permissible under the law governing these terms and conditions, LiveMusicFinder is not liable  in contract, tort or otherwise (including liability for negligence) for loss whether direct or indirect of business, revenue or profits, anticipated savings or wasted expenditure, loss or corruption or destruction of data or for any indirect or consequential loss or damage whatsoever resulting from your use of or inability to use the Website, or from your relying on the accuracy or completeness of the Website content.

LiveMusicFinder excludes all liability of any kind (including negligence) in respect of any third party information or other material made available on or which can be accessed using the Website.

8. Indemnity

You agree to indemnify LiveMusicFinder against all claims that anyone threatens or makes against LiveMusicFinder because you do not comply with these Conditions. LiveMusicFinder reserves the right to seek any indemnities available to it in law and in equity for such non- compliance.

9. Virus Protection

You must take all reasonable steps to ensure that any software you use with or in connection with the Website is not infected by viruses.

LiveMusicFinder will take all reasonable steps (including testing with the latest commercially available virus detection software) to ensure that any software used in connection with the Website is not infected by viruses.

10. Contributions by Members

From time to time developments to the LiveMusicFinder Website will enable members to add their own content such as reviews, forum entries, band/venue web page etc, Members are expressly forbidden to contribute any text, images, music or other material which are unlawful, disrespectful, obscene, or otherwise undesirable or anything that infringes the rights of another person whether or not that person is a member or a user of the site. Any complaints received in relation to such material will be investigated in a timely manner. At the discretion of LiveMusicFinder, any such material may be removed without notice and membership withdrawn immediately.

LiveMusicFinder respects the intellectual property of others, and requires that our users assume this principle whilst using the Website. You may not upload, post, embed, email, transmit or otherwise make available any material that infringes any copyright, patent, trademark, trade secret or other proprietary rights of any person or entity. At the discretion of LiveMusicFinder, any such material may be removed without notice and membership withdrawn immediately.

You represent and warrant that:

1. you own the Content posted by you on, through or in connection with the LiveMusicFinder Services, or otherwise have the right to grant the license set forth in this Section 6, and
2. the posting of your Content on, through or in connection with the LiveMusicFinder Services and/or Linked Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. You agree to pay for all royalties, fees, and any other monies owing any person or entity by reason of the use of any Content posted by you on or through the LiveMusicFinder Services and/or Linked Services.

LiveMusicFinder reserves the right to limit the storage capacity of Content that you post on the Website

In the interest of accuracy and for the benefit of other users and members, unconfirmed gigs, events or regular features should not be entered on to the Website. Any subsequent changes to gigs entered on to the Website should be corrected as soon as possible prior to the gig.

11. Privacy

LiveMusicFinder is compliant with UK privacy laws and is registered under the Data Protection Act. All personal data is kept secure in accordance with this act. Members of LiveMusicFinder will determine which personal information provided by that member can be published on the Website if any. This may include; name, address, telephone number, email address etc.

12. Third Party Rights

English law governs these Terms and Conditions, a person who is not party to these Terms and Conditions has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these Terms or Conditions, but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
To the extent permitted by law , you will indemnify LiveMusicFinder against any liabilities or costs arising from any and all claims by any third party in connection with the use of the Website.
